Terms of Service

1. Acceptance of Terms

By accessing or using PlatiqData Analytics ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Service. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Service Description

PlatiqData Analytics is a managed analytics platform operated by MySpace MyVibe LLC. The Service enables users to connect to databases, build interactive dashboards, explore data through SQL, and share insights with their teams.

The Service is provided as a multi-tenant SaaS platform with tiered subscription plans. Features and capabilities vary by subscription tier as described on our pricing page.

3. Account Registration and Security

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring that account information remains current and accurate

We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk to the platform.

4. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Transmit malware, viruses, or any destructive code
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service for cryptocurrency mining, load testing, or other resource-abusive activities
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with unauthorized parties

We may investigate violations and take appropriate action, including suspension or termination of access without notice.

5. Data Processing

PlatiqData stores metadata and dashboard configurations on our servers. Customer source data remains in customer-owned databases at all times. PlatiqData connects to your databases using encrypted credentials provided by you, the customer.

When you execute queries through the Service, results are transmitted in real time for display and are not permanently stored on our servers unless you explicitly configure caching. You retain full ownership and control of your source data.

6. Intellectual Property

The Service, including its user interface, design, documentation, and proprietary components, is owned by MySpace MyVibe LLC and is protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Service during your subscription period.

You retain all rights, title, and interest in your data, dashboards, queries, and any content you create using the Service. We do not claim ownership of your content.

7. Payment and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge the payment method on file at the applicable rate.

• We may change pricing with 30 days' written notice
• Refunds are provided at our discretion and only for unused service periods
• Failure to pay may result in suspension or downgrade of your account
• You are responsible for any applicable taxes

8. Embedded Analytics Terms

Customers on the Pro tier and above may embed PlatiqData dashboards and charts into their own applications using our embedded analytics features. When using embedded analytics:

• You are responsible for managing end-user access and authentication within your application
• Embedded content must comply with the same acceptable use policies described in Section 4
• Usage limits for embedded analytics are defined by your subscription tier
• You must not remove or obscure PlatiqData attribution where required by your plan

9. AI Features

Customers on the Scale tier may access AI-powered features, including natural language query generation. When using AI features:

• Database schema metadata (table names, column names, data types) is sent to our AI provider for query generation
• No raw data rows are transmitted to the AI provider
• Your data is not used for AI model training
• AI-generated queries should be reviewed before execution, as they may not always produce correct results

You acknowledge that AI features are provided as an assistive tool and that you are responsible for verifying the accuracy of AI-generated outputs.

10. Termination

You may terminate your account at any time by contacting us or using the account settings interface. We may terminate or suspend your access to the Service at any time for violations of these Terms or for any other reason with reasonable notice.

Upon termination:

• Your right to access the Service ceases immediately
• Dashboard configurations and metadata will be retained for 30 days, after which they may be permanently deleted
• We will not delete your source data, which remains in your own databases
• Any outstanding payment obligations survive termination

11. Limitation of Liability

To the fullest extent permitted by law, MySpace MyVibe LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Open Source Attribution

PlatiqData Analytics is built on Apache Superset, licensed under the Apache License 2.0. The full text of the Apache License 2.0 is available at apache.org/licenses/LICENSE-2.0.

We respect the open source community and comply with all applicable open source license obligations. A list of additional open source components used in the Service is available upon request.

13. Service Level

Enterprise tier customers receive a Service Level Agreement (SLA) as defined in their individual service agreement. The SLA specifies uptime commitments, response times, and remedies for service disruptions.

All other subscription tiers are provided on a reasonable-efforts basis. While we strive for high availability and reliability, we do not guarantee specific uptime percentages for non-Enterprise plans. Scheduled maintenance windows will be communicated in advance whenever possible.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
